- The foreign company or professional activity is real and has the required operating history
- The employment or professional relationship existed for the required pre-application period
- The work can genuinely be performed remotely through digital and telecommunications means
- Qualifications or relevant professional experience can be evidenced
- Income, insurance, social-security and criminal-record requirements are addressed
The employee evidence chain
An employee file should connect the employment contract, start date, duties, salary, payment history and employer authorisation to continue working remotely from Spain. The employer's identity and operating history should be independently supportable.
A generic statement that the role is flexible may not explain the actual arrangement. The permission letter should be consistent with the contract, payslips, bank credits and the planned move.
The freelancer evidence chain
A freelancer file should connect client contracts, the duration of each professional relationship, invoices, bank credits and permission or contractual terms allowing the work to continue remotely. Platform screenshots alone rarely explain the complete contractual and payment chain.
Where a payment processor, trading name or related company creates different names across the documents, add objective evidence that explains the connection rather than leaving the reviewer to infer it.
Activity for Spanish clients
The law distinguishes employment from professional activity. For qualifying professional activity, work for a company located in Spain is allowed only within the statutory limit. The calculation and supporting evidence should match the applicant's real client portfolio and current official interpretation.
Build a reconciliation table
- Counterparty legal name and country
- Relationship start date and contract term
- Remote-work wording
- Invoice or payslip references
- Matching bank credits and currency
- Company-history evidence
- Any Spanish activity and its documented share
